Legal Warranty

Every product sold by Feldi srl to a “consumer” purchaser is covered by the legal warranty on consumer goods, which covers defects in conformity that manifest within 24 months from the date of delivery of the good. Wearable materials (including batteries, electrodes, cables, gels, masks, and cups) are specifically excluded from this Warranty, unless wear or damage is attributable to a defect in material or manufacturing.

Unless expressly stated otherwise, the current regulations apply.

What is the legal warranty?

It is the warranty on the sale of consumer goods provided by the EU Directive 1999/44/EC, also known as “warranty of conformity,” which protects you in case the products you purchase exhibit defects in conformity with the sales contract (“Legal Warranty”).

To receive warranty assistance for products sold by Feldi srl and for Tesmed branded products, you can contact Customer Service by writing to info@tesmed.com and you will receive a response within one working day.

What is the duration of the Legal Warranty?

The Legal Warranty covers defects in conformity that manifest within 24 months from the date of delivery of the product you purchased, even if at that date the defect was not immediately apparent. To enforce it, you must notify the seller of the defect within 2 months from when you discovered it. 

We recommend always keeping the purchase receipt if you buy the good from an authorized retailer, such as a pharmacy. For online purchases made through the site www.tesmed.it and www.tesmed.com, it is sufficient to keep the confirmation email of shipment and/or the order confirmation email.

Am I entitled to the Legal Warranty?

The Legal Warranty is a right granted only to consumers, that is, to those who purchase products for non-professional purposes. For example, if you purchase an electrostimulator exclusively for personal use, you are entitled to the Legal Warranty. Conversely, if you purchase it for use in your work activity, the Legal Warranty does not apply.

Against whom can I assert the Legal Warranty?

If you are a consumer, you can assert the Legal Warranty against the party that sold you the product, even if it is a party different from Feldi srl. For products purchased from Feldi srl through the site www.tesmed.it and www.tesmed.com, Feldi srl is responsible. 

Warranty assistance for the above products will therefore be provided by the seller, according to their own conditions.

What rights does the Legal Warranty grant me?

If the product you purchased has a defect covered by the Legal Warranty, you are entitled, without incurring any costs, to have the defective product repaired or replaced by the seller. You have the right to a price reduction or to terminate the contract in the following cases: (a) if the replacement or repair of the product is not possible or is excessively costly; (b) if the seller has not provided for the repair or replacement of the product within a reasonable time; or (c) if the replacement or repair of the product has caused you significant inconvenience. To determine the amount of the price reduction or the sum you are entitled to in these cases, consideration will be given to the use you have made of the product. Please note that a minor defect for which it was not possible or excessively costly to pursue the remedies of repair or replacement does not entitle you to terminate the contract.

There is no right to request the warranty if the defect or damage was caused by improper use. 

Examples of non-compliant actions include: repairs or interventions performed by unauthorized persons by the manufacturer on the device (this is equivalent to an intervention by an unauthorized third party) – manipulation of assembly components – manipulation of software – defects or damage caused by falling, breaking, or liquid infiltration. 

The breaking of seals or tampering with the product results in the expiry of the Warranty.

All Tesmed products are aids for the activity for which they are intended. It is therefore the user's responsibility to use the necessary caution and judgment during their use.

Feldi srl will not be liable for any violation of laws, as well as for the normal rules of diligence and caution.

What to do if a conformity defect is present?

To receive warranty assistance for products sold by Feldi srl and for Tesmed branded products, you can contact Customer Service by sending an email to info@tesmed.com.

Our customer service operators will help you resolve the issue encountered while using the product you purchased.

If it emerges that the problem stems from a conformity defect, a case will be opened in your name and the product will be repaired or replaced free of charge under the warranty for the defective product.

Please note that, in the case of replacement, we will ensure that the replacement product is delivered to you within 30 days and you will not have to pay the shipping costs for the replacement or repair product.

Assistance beyond the warranty period

If the product exhibits operational problems beyond the warranty period, or if it is not covered, the buyer must contact Customer Care at the email address info@tesmed.com to agree on the method of sending the device for repair or inspection.

In the case of out-of-warranty assistance, the buyer is responsible for transportation costs as well as repair and inspection costs. 

Feldi srl reserves the right not to carry out repairs when the damaged parts to be replaced for the restoration of the product are no longer available or when the repair, considering the value of the asset and the cost of the intervention, is uneconomical.
