Right of withdrawal

If the customer is a consumer, i.e. a natural person who purchases goods for purposes not related to their professional activity, they have the right to withdraw from the contract and return the ordered products within 14 (fourteen) working days from receipt of the products, without providing any explanation.
To exercise this right, the Customer must send Feldi srl a notice by registered letter within 14 working days from the date of receipt of the goods. This communication must be sent to:

The goods must be returned to the same address by traceable postal package or by express courier.
The right of withdrawal is subject to the following conditions:

  • The purchased item must be intact and returned in its original packaging, complete in all its parts;
  • The shipping costs for returning the item are borne by the Customer.

Without prejudice to any restoration costs for damage to the original packaging, Feldi srl will refund the Customer the full amount already paid for the goods (excluding any shipping costs applied), by sending a non-transferable cheque in the Customer’s name. The cheque is sent by registered mail to the Customer’s address.
Our staff are not authorized to accept shipments sent cash on delivery or with shipping costs charged to the company; in such cases the return will be automatically rejected.
The right of withdrawal cannot be exercised by those who purchase Tesmed branded products in pharmacies.

 

Legal Warranty

Every product sold by Feldi srl to a “consumer” buyer is covered by the legal warranty on consumer goods, which covers conformity defects that appear within 24 months from the date of delivery of the goods. Materials subject to wear and tear (including batteries, electrodes, cables, gels, masks and cups) are specifically excluded from this Warranty, unless the wear or damage is attributable to a material or manufacturing defect.

For anything not expressly stated, the applicable laws in force shall apply.

What is the legal warranty?

It is the warranty on the sale of consumer goods provided by Directive 1999/44/EC, also known as the “conformity warranty”, which protects you in the event that the products you purchase have conformity defects with respect to the sales contract (“Legal Warranty”).

To receive warranty assistance on products sold by Feldi srl and Tesmed branded products, you can contact Customer Service by writing to info@tesmed.com and you will receive a reply within one working day.

What is the duration of the Legal Warranty?

The Legal Warranty covers conformity defects that appear within 24 months from the date of delivery of the product you purchased, even if the defect was not immediately detectable at that time. To enforce it, you must notify the seller of the defect within 2 months from when you discovered it. 

We recommend always keeping the purchase receipt if you buy the product from an authorized retailer, such as a pharmacy. For online purchases made through the website www.tesmed.it as well as www.tesmed.com, it is sufficient to keep the shipping confirmation email and/or the order confirmation email.

Am I entitled to the Legal Warranty?

The Legal Warranty applies only to consumers, i.e. those who purchase products for non-professional purposes. For example, if you purchase an electrostimulator exclusively for personal use, you are entitled to the Legal Warranty. Conversely, if you purchase it for use in your work activity, the Legal Warranty does not apply.

Against whom can I enforce the Legal Warranty?

If you are a consumer, you can enforce the Legal Warranty against the seller who sold you the product, even if it is a party different from Feldi srl. For products purchased from Feldi srl through the website www.tesmed.it as well as www.tesmed.com, Feldi srl is responsible. 

Warranty assistance for the above products will therefore be provided by the seller, according to their own conditions.

What rights does the Legal Warranty grant me?

If the product you purchased has a defect covered by the Legal Warranty, you are entitled, without any expense, to repair or replacement of the defective product by the seller. You are entitled to a price reduction or termination of the contract in the following cases: (a) if replacement or repair of the product is not possible or is excessively burdensome; (b) if the seller has not repaired or replaced the product within a reasonable time; or (c) if replacement or repair has caused you significant inconvenience. To determine the amount of the price reduction or the sum you are entitled to in these cases, the use you have made of the product is taken into account. Please note that a minor defect for which repair or replacement is impossible or excessively burdensome does not entitle you to terminate the contract.

There is no right to claim the warranty if the defect or damage was caused by improper use. 

The following actions are considered non-compliant, for example: repairs or interventions carried out by persons not authorized by the manufacturer to open the device (equivalent to intervention by an unauthorized third party) – tampering with assembly components – software tampering – defects or damage caused by drops, breakage, or liquid infiltration. 

Any breaking of seals or tampering with the product will result in the loss of the Warranty.

All Tesmed products are aids for carrying out the activity for which they are intended. It is therefore the sole responsibility of the user to use the necessary caution and judgment during their use.

Feldi srl shall not be liable for any failure to comply with laws, as well as with the ordinary rules of diligence and prudence.

What should I do in case of a conformity defect?

To receive warranty assistance on products sold by Feldi srl and Tesmed branded products, you can contact Customer Service by sending an email to info@tesmed.com.

Our customer service operators will help you resolve the problem encountered while using the product you purchased.

If it emerges that the problem is due to a conformity defect, a case will be opened in your name and the product will be repaired or replaced free of charge under warranty.

Please note that, in case of replacement, we will deliver the replacement product within 30 days and you will not have to pay shipping costs for the replacement or repair.

Out-of-warranty assistance

If the product shows malfunctioning beyond the warranty period, or if the warranty does not apply, the purchaser must contact Customer Care at info@tesmed.com in order to arrange the method of sending the device for repair or inspection.

In the case of out-of-warranty assistance, transport costs are borne by the purchaser, as well as repair and inspection costs. 

Feldi srl reserves the right not to carry out repairs when the damaged parts needed for replacement are no longer available to restore the product, or when the repair is uneconomical considering the value of the item and the cost of the intervention.
