Every product sold by Feldi srl to a "consumer" purchaser is covered by the legal guarantee on consumer goods, which covers non-conformity defects that manifest within 24 months from the date of delivery. Wear-and-tear materials (including batteries, electrodes, cables, gel, masks, and cups) are specifically excluded from this Warranty, unless the wear or damage is due to a material or manufacturing defect.

For anything not expressly written, the current regulations apply.

What is the legal warranty?

It is the warranty on the sale of consumer goods provided by the EU Directive 1999/44/EC, also known as the "conformity warranty," which protects you in the event that the products you purchase show non-conformity defects with respect to the sales contract ("Legal Warranty").

What is the duration of the Legal Warranty?

The Legal Warranty covers non-conformity defects that manifest within 24 months from the delivery date of the product you purchased, even if the defect was not immediately noticeable at that time. To claim it, you must notify the seller of the defect within 2 months of discovering it. 

We recommend always keeping the purchase receipt if you buy the product from an authorized retailer, such as a pharmacy. For online purchases made through the www.tesmed.it website as well as www.tesmed.com, it is sufficient to keep the shipping confirmation email and/or order confirmation email.

Warranty extension in Spain

On April 28, 2021, the Spanish government issued Decree-Law 7/2021, which implements EU Directives 2019/771 and 2019/770. Under this decree, which came into effect on January 1, 2022, the legal warranty on the conformity of goods is extended from two to three years from the time the product is delivered and remains two years for services or digital content.

Am I entitled to the Legal Warranty?

The Legal Warranty is available by right only to the consumer, i.e., those who purchase products for non-professional purposes. For example, if you purchase a muscle stimulator exclusively for personal use, you are entitled to the Legal Warranty. Conversely, if you buy it for use in your business, the Legal Warranty does not apply.

Who can I enforce the Legal Warranty against?

If you are a consumer, you can enforce the Legal Warranty against the seller of the product, even if it is a party other than Feldi srl. For products purchased from Feldi srl through the www.tesmed.it and www.tesmed.com websites, Feldi srl is responsible. 

Warranty assistance for the above products will therefore be provided by the seller, based on their conditions.

What rights does the Legal Warranty give me?

If the product you purchased has a defect covered by the Legal Warranty, you are entitled, without any cost to you, to have the defective product repaired or replaced by the seller. You are entitled to a price reduction or contract termination in the following cases: (a) if the replacement or repair of the product is not possible or is excessively expensive; (b) if the seller has neither repaired nor replaced the product within a reasonable period of time; or (c) if the replacement or repair of the product has caused you significant inconvenience. To determine the amount of the price reduction or the sum to which you are entitled in these cases, the use you have made of the product is taken into account. Note that a minor defect for which it was not possible or excessively expensive to apply the remedies of repair or replacement does not entitle you to terminate the contract.

There is no right to request the warranty if – the defect or damage was caused by improper use. 

Examples of non-conformity include the following actions: repairs or interventions performed by individuals not authorized by the manufacturer to open the device (this is equivalent to the intervention of an unauthorized third party) – manipulation of assembly components – software manipulation – defects or damage caused by falls, breakage, or liquid infiltration. 

The breakage of seals or tampering with the product voids the Warranty.

All Tesmed products are aids in performing the activities for which they are intended. It is therefore solely the user's responsibility to exercise the necessary caution and judgment during their use.

Feldi srl will not be liable for any non-compliance with laws, as well as normal rules of diligence and caution.

What to do in the presence of a non-conformity defect?

To receive warranty assistance on products sold by Feldi srl and Tesmed-branded products, you can contact Customer Service by sending an email to info@tesmed.com.

Our customer service agents will help you resolve the issue you are experiencing with the product you purchased.

If it turns out that the issue is due to a non-conformity defect, a case will be opened in your name, and the product will be repaired or replaced for free under the product warranty.

Please note that, in case of replacement, we will deliver the replacement product within 30 days, and you will not have to pay the shipping costs for the replacement or repair product.

Support beyond the warranty period

If the product experiences operational problems beyond the warranty period or if the warranty does not apply, the purchaser must contact Customer Care at info@tesmed.com to agree on the method of sending the device for repair or inspection.

For out-of-warranty assistance, the buyer is responsible for transportation costs as well as repair and inspection costs. 

Feldi srl reserves the right not to perform repairs when replacement parts necessary for restoring the product are no longer available or when the repair, considering the value of the product and the cost of the intervention, is not economically viable.
